Qualification issues get Emanuel tossed from Chicago mayor race

The Chicago mayor race has lost at least one candidate for now, that being Rahm Emanuel. Emanuel’s candidacy was contested on grounds that he did not reside in Chicago enough to qualify, however his right to run was initially upheld in court. That judgment was appealed. The appeals court overturned the decision, and Emanuel is out of the race for now. It makes you wonder how many more payday loans could be taken out to bring this battle back to the courtroom.

Prospect Emanuel out of the running for Chicago mayor

For the moment, it appears that Rahm Emanuel is out of the competition to be the next Chicago mayor, according to the Chicago Sun Times. Emanuel was found by the Illinois Court of Appeals to not have satisfied residency needs to run for office. In order to run for this position, Emanuel left his position as White House Chief of Staff. Current mayor Richard M. Daley will be stepping down. He had been mayor since 1989 though. Legendary Chicago Mayor Richard J. Daley was Daley's father while Daley is also brother to William M. Daley who was White House Chief of Staff before Emanuel.

Emanuel doesn't meet requirements to be eligible to competition

Rahm Emanuel went to court once before. This was also for the Chicago mayor case. Emanuel was confirmed eligible to run for mayor in December 2010 by the Chicago Board of Elections. When challenged in court, a Cook County judge held up the ruling. There was an appeal on the decision though. With this appeal, Emanuel was taken off the ballot as part of the ruling. The law states that a candidate has to have lived in the city in which he intends to run for at least a year prior to election day. Rob Halpin had been renting out the Chicago residence from Emanuel while Emanuel wasn't there. Obviously Emanuel hadn't been living there at the time.

Appeal is very possible

This decision might be appealed by Emanuel. It’s very feasible that the Illinois Superior Court might say no to an appeal thinking about the attorney who did the appeal against Emanuel explained the opinion on qualification really well. If no appeal is filed, Emanuel could be stricken from the ballot.
